Senator John Thune (R-S.D.) made a motion to proceed to S. 1318, which would extend for three years the expiration date of Title VII of the Foreign Intelligence Surveillance Act (FISA) of 1978, including Section 702 that has been used to spy (without a warrant) on American citizens who electronically communicate with targeted foreigners.
The Senate rejected Thune's motion on June 5, 2026 by a vote of 47 to 52 (Roll Call 164). We have assigned pluses to the nays because spying on American citizens without a warrant is an egregious violation of the Fourth Amendment.
