During consideration of the Secure America Act (S. 2), Senator Dick Durbin (D-Ill.) made a motion to waive the Budget Act against a point of order raised against his amendment to redirect $10 million in funds for U.S. Immigration and Customs Enforcement to the Deferred Action for Childhood Arrivals (DACA) program. The amendment would also prohibit the use of the funds to detain or deport DACA recipients.

The Senate rejected Durbin's motion on June 5, 2026 by a vote of 48 to 51 (Roll Call 152). We have assigned pluses to the nays because this amendment would defund federal immigration enforcement for the purpose of providing amnesty to illegal aliens. Illegal aliens ought to be deported from the United States. Mass migration, which is an "Invasion" per the Constitution, has become the most immediate threat to America. It destroys national unity, allegiance, and sovereignty by undermining both the rule of law and the value of citizenship. "We the People" must demand secure borders, the deportation of every illegal, and a moratorium on all immigration until the crisis ends.
