HB1989 legalizes the direct sale of raw milk and raw-milk products from producers to consumers for human consumption, under specific conditions. It also allowed raw goat milk sales for pet use.

The Hawaii State House of Representatives passed HB1989 on March 5, 2024 by a vote of 39 to 10. We have assigned pluses to the ayes because the federal prohibition on the sale of raw milk violates the First, Fifth, and Fourteenth Amendments of the U.S. Constitution, as well as free-market principles, as the government should not interfere in commerce. This legislation is a strong step in the right direction, embracing the constitutional principle of nullification by pushing back against unconstitutional federal acts.
