Nonprofits that hold easements cannot later sell or release them, and government entities are not eligible for grants.

It is not the purpose of governments to regulate land conservation or land ownership.

It also paves the way for future mandates under the banner of “reproductive rights.” Moreover, hormonal birth control—particularly high-dose “morning-after” pills—can act as abortifacients by preventing implantation, causing early, unseen abortions. The care of human life—not its destruction—is the highest duty of government. States should work to prohibit all methods of abortion and protect every pre-born child’s right to life, as affirmed in the Declaration of Independence and safeguarded by the Fifth and 14th Amendments to the U.S. Constitution.

SB836 authorizes Local Education Agencies (LEAs) and public charter schools to refuse to enroll students who are unlawfully present in the United States.

The Tennessee State Senate passed SB836 on April 10, 2025 by a vote of 19 to 13. We have assigned pluses to the ayes because taxpayer-funded education is not the role of government and should not be extended to those who have entered the country illegally, especially when public schools are already burdened with declining academic outcomes and rising costs. SB836 helps deter illegal migration by removing one of its incentives—"free" government education—and reinforces the principle that state resources should serve citizens and legal residents first. Education is not a legitimate function of government, and certainly not a service that should be extended to those in the United States Illegally. This bill supports state sovereignty and upholds the rule of law—and critics of the bill claim it jeopardizes federal funding, which would be a win.

HB1237 ends the ability of state regulatory and health-related boards to use race, color, ethnicity, or national origin as factors in their membership decisions. It bans race-based policies such as quotas and affirmative action on these boards, and removes older requirements that certain boards include minority representatives. The law also allows individuals to sue boards that discriminate, with a minimum of $4,000 in statutory damages and potential for additional actual or punitive damages.

The Tennessee State House of Representatives passed HB1237 on April 7, 2025 by a vote of 73 to 22. We have assigned pluses to the ayes because, while many of these regulatory and health-related boards are unconstitutional to begin with, state governments should not prop up one group over another based on race or ethnicity. Such policies embrace equity over equality—undermining the foundational American principle that all individuals are to be treated equally under the law. Race-based preferences constitute reverse discrimination and racism and conflict with the fundamental principle expressed in the Declaration of Independence: “That all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the pursuit of Happiness.” Additionally, efforts to elevate or exclude individuals based on race—whether through segregation, quotas, or affirmative action—have always undermined justice and fostered division rather than unity.

HB749 makes it a Class B misdemeanor to drive in Tennessee using an out-of-state driver's license issued exclusively to illegal aliens.

SB734 extends by six years the authority for Nashville-Davidson County to continue collecting a hotel occupancy tax of up to $2.50 per room, instead of $2.00. The extra $0.50 will continue to fund the county’s Event and Marketing Fund, which brings in about $5 million annually. The bill also extends the terms of the Event and Marketing Fund Committee members.

The Tennessee State House of Representatives passed SB734 on March 24, 2025 by a vote of 58 to 22. We have assigned pluses to the nays because this bill extends a local tax increase and continues funneling millions in taxpayer-generated revenue into government-controlled marketing efforts—an approach that is not constitutionally grounded. Instead of letting the free market determine tourism and event success, SB734 expands the role of government in promoting private industry, embracing corporate welfare, distorting market forces, and encouraging cronyism. Using tax dollars to subsidize entertainment, tourism, or large venues through an unelected marketing committee is not the proper role of government. Legislators should oppose policies that empower government to pick winners and losers.

SB827 exempts fully online, self-paced private schools from certain regulations. The State Board of Education can no longer mandate these schools adhere to rules on class size, school calendar, vaccination requirements, or student assessments to qualify as Category III nonpublic schools—simplifying regulatory hurdles for online private-education providers.

The Tennessee State Senate passed SB827 on March 20, 2025 by a vote of 26 to 5. We have assigned pluses to the ayes because this bill takes an important step toward reducing government overreach in education by exempting fully online, self-paced private schools from unnecessary regulations. Education is not a proper function of government, and SB827 supports the fundamental right of parents to direct their children’s education—an unalienable right protected by the U.S. Constitution. By removing state-imposed mandates on class size, calendars, testing, and vaccinations for these private institutions, the bill affirms educational freedom and encourages innovation outside the failing public system. We urge all parents to take control of their children’s education and pursue sound alternatives, such as homeschooling or independent, patriotic private schools like FreedomProject Academy, which remain free from government funding and control.

SB480 removes Tennessee’s broad definition of “blighted area” and instead defines “blighted property” case-by-case, based on specific, uncorrected safety or code violations. The bill gives property owners advance notice and time to fix issues before their land can be taken by housing authorities. It also lets those authorities purchase non‑blighted properties (even above market value) without using eminent domain. These changes narrow the scope of when and how government bodies can seize property, strengthen due-process rights, and support negotiated sales for redevelopment.

The Tennessee State Senate passed SB480 on March 6, 2025 by a vote of 30 to 0. We have assigned pluses to the ayes because this bill strengthens private-property rights and restores some proper constitutional limits on government power. By eliminating the vague and overly broad definition of "blighted area," SB480 helps prevent abuse of eminent domain—where governments seize land under the guise of redevelopment. Instead, the bill ensures that landowners are given notice and a fair opportunity to address concerns. This reinforces the due-process protections guaranteed by the fifth and 14th Amendments, which prohibit the government from depriving individuals of life, liberty, or property without due process of law and require just compensation for takings.

HB6004 creates a state-funded scholarship program offering up to 20,000 K–12 vouchers for private-school tuition and related expenses. Half are reserved for low-income or otherwise eligible students, while the rest are open to all qualifying applicants. Each scholarship is worth about the same as the state’s base Tennessee Investment in Student Achievement (TISA) funding and can be used for tuition, tutoring, transportation, and more. Participating private schools must give annual standardized tests in grades 3–11, with results reported to the General Assembly. To protect public schools, the state will maintain prior-year TISA funding for districts losing students to the program. The bill also includes a one-time $2,000 bonus for public school teachers (with local approval) and directs 80% of sports betting tax revenue to school facility upgrades.

The Tennessee State House of Representatives passed HB6004 on January 30, 2025 by a vote of 54 to 43. We have assigned pluses to the nays because, while private and home education are better options, this bill expands government control by funding private schooling with taxpayer dollars—propping up people and institutions the free market would otherwise hold accountable. Government funding always comes with strings, and HB6004 proves this by requiring participating private schools to administer annual standardized tests and report results to the state. This undermines the independence of private education and sets a dangerous precedent. Education is not a legitimate function of government, and using public funds to boost teacher pay by $2,000 to secure buy-in appears more like political leverage than reform. Instead of reducing government’s role in education, this bill grows it—further entrenching a system plagued by academic failure, taxpayer waste, and ideological indoctrination. We urge parents to exit the government school system altogether and seek truly independent alternatives such as homeschooling or private institutions, including FreedomProject Academy, that reject government funding and oversight, and embrace parental rights.

SB6003 establishes two new funding sources to support disaster recovery. The first is the Hurricane Helene Interest Payment Fund, which provides up to $110 million to help local governments in federally declared disaster areas cover interest costs on recovery loans, with the state paying up to 5% interest for up to three years. The second is the Governor’s Response and Recovery Fund, which allocates $100 million for emergency relief through grants or loans for expenses such as agricultural aid, unemployment support, and business recovery.

The Tennessee State Senate passed SB6003 on January 29, 2025 by a vote of 32 to 1. We have assigned pluses to the nays because, as President Grover Cleveland stated in his 1887 veto message for the Texas Seed Bill, “I can find no warrant for such an appropriation in the Constitution, and I do not believe that the power and duty of the General Government ought to be extended to the relief of individual suffering…. Though the people support the Government the, Government should not support the people.” Both that bill and SB6003 are intended to secure government assistance for local disasters. However, it is not the government’s role to solve every problem; these issues should be addressed by the private sector, the generosity of our friends and neighbors, and the principles of individualism.

SB2269 requires the Department of Human Services to identify any federal regulations or state law or rules that inhibit its ability to deliver benefits for the food assistance program.

The House passed SB2260 on April 24, 2024, by a vote of 57 to 27. We have assigned pluses to the noes because providing “food assistance,” especially to “able-bodied adults without dependents,” is not the role of government. There exists no “right to food” apart from a person working and earning it themselves or having received it privately and voluntarily from someone else. Taxation in the name of “social welfare” is neither just nor charitable. “Public assistance benefits” rely on the unconstitutional and discriminatory use of federal and state taxpayer money on behalf of some citizens (particularly those who have little or no tax liability) at the expense of others, resulting in more debt, dependency, and poverty. The Supplemental Nutrition Assistance Program (SNAP) is not authorized under Article I, Section 8, of the U.S. Constitution.  

SB1325 authorizes a faculty or staff member of a school to carry a concealed handgun on school grounds.

The House passed SB1325 on April 24, 2024, by a vote of 68 to 28. We have assigned pluses to the ayes because this bill eases blatantly unconstitutional gun control restrictions on teachers and staff members. “Gun-free zones” in schools are demonstrably unsafe. Every person has a natural and individual right to self-defense, irrespective of their location, which is why the Second Amendment to the U.S. Constitution guarantees that “the right of the people to keep and bear Arms, shall not be infringed.”  

HB1605 would prohibit the display of any flag other than the United States flag and the official Tennessee state flag in public schools.

The Senate failed to pass HB1605 on April 23, 2024, by a vote of 13 to 6 (simple-majority vote of 17 needed). We have assigned pluses to the ayes because this bill would have rightfully banned the LGBTQ+ “Pride” flag from being displayed in government schools. Flags are age-old symbols of sovereignty, allegiance, and honor. Unlike the “Flag of the United States of America, and to the Republic for which it stands,” the rainbow-colored “Pride” flag represents the “abomination” of a rival global totalitarian movement and invading force that has openly mocked and declared war against the “Laws of Nature and of Nature’s God.” In Marxist fashion, it seeks to stake a territorial claim over all of society through a “long march through the institutions,” specifically by indoctrinating young students into “affirming” homosexuality and other forms of sexual perversion. Nevertheless, Americans have been warned that “Pride goes before destruction,” and “if we ever forget that we are one Nation under God, then we will be a nation gone under.” It explains why the U.S. Flag Code has always and only required that the U.S. flag should be displayed “daily” at “every public institution” across the country, including “during school days in or near every schoolhouse.”

SB1834 authorizes the death penalty as a punishment for “rape” of a child, “aggravated rape” of a child, or “especially aggravated rape” of a child.

The Senate passed SB1834 on April 23, 2024, by a vote of 23 to 5. We have assigned pluses to the ayes because justice is the overall purpose of civil government. The State of Tennessee has a dual role of securing the “unalienable Rights” to life, liberty, and property while punishing anyone responsible for depriving them. A person convicted of child rape can only themself be held accountable for their own actions, and punishment for one’s crimes must be borne by that individual. Rape, which is a deep violation of personhood and often involves the shedding of innocent blood, is a serious crime that demands capital punishment, for mankind has been created in the image of God. The U.S. Constitution’s “due process” and “equal protection” requirements justly follow the Common Law retributive principle that “the punishment should fit the crime.”

HB2452 would remove the provision of state law that declares “it is the responsibility” of each parent to ensure that their child receive the vaccines “recommended” by the Centers for Disease Control and Prevention or the American Academy of Pediatrics.

The House passed HB2452 on April 15, 2024, by a vote of 73 to 25. We have assigned pluses to the ayes because parents—not the government—ought to decide whether their child should be vaccinated. Child immunization requirements must be opposed, as a parent’s non-injurious healthcare decisions are private family matters not under federal, state, or local jurisdiction in the United States. Forcing every child to be vaccinated under the guise of ‘preventive medical treatment’ violates the fundamental rights of parents protected by the Bill of Rights and the 14th Amendment.

HJR5 applies to Congress to “call a convention” under Article V of the U.S. Constitution for the purpose of proposing amendments that would set term limits on members of Congress.

The Senate passed HJR5 on April 11, 2024, by a vote of 18 to 11. We have assigned pluses to the noes because term limits conflict with the right of the American people to choose their representatives. Moreover, an Article V constitutional convention (Con-Con) ought to be resisted. Instead of failing to uphold their oath of office and attempting to rewrite the U.S. Constitution, legislators should act to immediately nullify all unconstitutional federal laws. Whenever the federal government assumes undelegated powers, in violation of the 10th Amendment, nullification of such acts is the proper remedy. Article V was designed to correct potential errors or defects in the Constitution, not to “misconstrue or abuse its powers.” The several States must use Article VI to enforce the Constitution, rather than use Article V to change it.

SB1738 prevents the Department of Children’s Services from denying a parent’s ability to foster or adopt based upon the parent’s religious or moral beliefs regarding “sexual orientation or gender identity.”

The House passed SB1738 on April 1, 2024, by a vote of 73 to 20. We have assigned pluses to the ayes because this bill defends the religious liberty of foster and adoptive parents. No current or prospective parent should ever be compelled to “affirm, accept, or support” LGBTQ+ ideology under threat of the full force and sanctioning of the government. Indeed, Christians and other parents who wish to adopt children, but reject fictional “gender identity” constructs, should be honored, not persecuted. Article 1, Section 3 of the Tennessee Constitution clearly states that “all men have a natural and indefeasible right to worship Almighty God according to the dictates of their own conscience” and that “no human authority can, in any case whatever, control or interfere with the rights of conscience.” On the contrary, there is nothing in the U.S. Constitution that can be used to support homosexuality, sex mutilation, or other forms of “gender affirming” behavior, which should be illegal. These grossly illicit, self-inhibiting, and unsanitary acts of sexual perversion violate the “Laws of Nature and of Nature’s God,” making them destructive of self-government and the family—the very foundations of a free society.

SB2219 amends the state’s definition of “money” to exclude Central Bank Digital Currency.

The House passed SB2219 on April 1, 2024, by a vote of 77 to 14. We have assigned pluses to the ayes because a Central Bank Digital Currency would be an unconstitutional and intolerable expansion of tyranny under the Federal Reserve—presenting a significant danger to Americans’ civil liberties by decimating personal privacy and allowing for a full-fledged surveillance state. According to Article 1, Section 10, of the U.S. Constitution, “No State shall…make any Thing but gold and silver Coin a Tender in Payment of Debts.” The States can and must act now to avow their adherence to constitutionally sound money.

HJR849 urges “Congress and the President to withdraw the United States from the United Nations.”

The House passed HJR849 on April 1, 2024, by a vote of 66 to 25. We have assigned pluses to the ayes because the United States should fully withdraw from the entire United Nations system, including its funds and programs, specialized agencies, and other related bodies and organizations. The UN poses one of the greatest threats to U.S. national sovereignty and the God-given rights of the American people. Since 1945, the UN Charter, which is completely antithetical to the U.S. Constitution, has established an international framework for expanding global governance, with the ultimate goal of building a one-world state. Americans must reject the “zeitgeist” of globalism and call on Congress and the President to pursue a sound, just, and traditional foreign policy of non-interventionism, based on U.S. interests and the original intent of the Founding Fathers. It’s time to Get US Out! of the UN.

  HB2124 directs local law enforcement agencies to cooperate with federal officials in the identification, apprehension, detention, or removal of aliens not lawfully present in the United States. The Senate passed HB2124 on March 25, 2024, by a vote of 26 to 7. We have assigned pluses to the ayes because persons who enter the United States illegally—which, by definition, is a crime—should not be permitted sanctuary in Tennessee, let alone be aided and abetted by local law enforcement officials. Article I, Section 8, of the U.S. Constitution clearly gives Congress power to “establish a uniform Rule of Naturalization.” Rather than pursue blatantly unconstitutional and anti-American policies that undermine the rule of law and erode the value of citizenship, each of the several States should exercise its sovereign powers under the 10th Amendment to end the illegal-migrant invasion and provide for the public safety.

SB2840 specifies that a court may order “reasonable visitation” to grandparents when it is in the “best interests of the child” if such visitation is opposed by the child’s custodial parent(s).

The Senate passed SB2840 on March 18, 2024, by a vote of 32 to 0. We have assigned pluses to the noes because final decision-making authority over the upbringing and care of a child belongs to the child’s parents—not their grandparents, the government, or anyone else. No law-abiding custodial parent should ever be compelled to relinquish their child under threat of the full weight and force of the judicial system. Opponents of traditional marriage and the family are also working tirelessly in each of the several States to proceed beyond “no-fault divorce” by advocating for “equal-shared parenting” and similar “best interests of the child” legislation that seeks to rewrite U.S. family law entirely, being modeled after the United Nations Convention on the Rights of the Child. If these efforts are not defeated, they will have severe long-lasting consequences for parental rights in America. Tennessee officials must stand firm against this intrusion. Parental rights, as with all other fundamental rights, are protected by the Bill of Rights and the 14th Amendment. Article VI, Section 2, of the Constitution notably requires that “Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”

SB269 changes the designation of June 19, known as "Juneteenth," from a day of special observance to a legal holiday.

The Wisconsin State Senate passed SB269 on March 23, 2023 by a vote of 24 to 4. We have assigned pluses to the nays because the United States observes 10 federal holidays, and the state of Tennessee already observes 11. Designating Juneteenth, which at the national level was voted as “National Independence Day” instead of July 4, falsely implies differing independence days based on race. This aligns with divisive strategies, akin to communist tactics of “dividing the people.”

HB1085 extends the allocation of state sales tax revenue to Memphis, specifically for the Memphis Grizzlies and events at the FedExForum, until June 30, 2059. During this period, revenue from admissions, sales of food and drink, and other authorized products at the FedExForum will be exclusively directed to Memphis and its sports authority.

The Tennessee State House of Representatives passed HB1085 on April 21, 2023 by a vote of 78 to 11. We have assigned pluses to the nays because privately-owned billion-dollar organizations, such as the Memphis Grizzlies, should be expected to pay for their own facilities, which they can more than afford. Forcing people to furnish profligate amounts of taxpayer money when attending games or concerts to fund crony, corporate-sponsored projects violates their individual liberties guaranteed by the Bill of Rights and the 14th Amendment to the U.S. Constitution.

SB600 prohibits local governments from expending funds for the purposes of assisting a person in obtaining a criminal abortion.

The right to life is the most fundamental, God-given, and unalienable right asserted in the Declaration of Independence and protected by the 5th and 14th Amendments to the U.S. Constitution. SB600 prohibits local governments from expending funds for the purposes of assisting a person in obtaining a criminal abortion.

HB252 eliminates the obligation for parents or teachers of homeschooled students to provide proof of immunizations and health services to the local education agency.

SB638 broadens the eligibility for education savings accounts (ESAs) to include students who were not enrolled in a Tennessee public school for the full year before receiving an ESA but were enrolled in and attended a Tennessee public school.

The Tennessee State Senate passed SB638 on February 27, 2023 by a vote of 27 to 5. We have assigned pluses to the nays because, while the idea of allowing money to any school of the students and parents choice may initially sound appealing, it raises concerns. This policy essentially directs government funds toward supporting private schools, inevitably attaching certain conditions and implications to this financial support. Private schools should not accept government money.

SB1 prohibits healthcare providers from performing certain medical procedures on minors or administering specific treatments if the purpose is to help the minor identify with or live as an identity that is claimed but inconsistent with the minor's biological or assigned sex at birth.
