HJR1 is the second-session approval of a proposed amendment adding Section 11-A to Article I of the Constitution of Virginia, which would declare that every individual has a fundamental right to "reproductive freedom," including abortion. The Commonwealth could regulate abortion in the third trimester, but could not prohibit an abortion that a physician judges medically indicated to protect the life, physical, or mental health of a "pregnant individual." The Commonwealth could not penalize a person for exercising the "right," or penalize anyone who, with consent, aids another in exercising the "right." Because this is the second consecutive-session approval required by Article XII, the amendment is to be submitted to the voters.

The Virginia House of Delegates passed HJR1 on January 14, 2026 by a vote of 64 to 34. We have assigned pluses to the nays because this amendment would write an expansive "right" to abortion into the Virginia Constitution. Given that the care of human life—not its destruction—is the greatest responsibility of government, Virginia ought to forbid abortion and other grotesque methods of population control entirely, upholding the sanctity of life for every person. The right to life is the most fundamental, God-given, and "unalienable" right asserted in the Declaration of Independence and guaranteed by the Fifth and 14th Amendments to the U.S. Constitution.
