SB322 enters Virginia into the Agreement Among the States to Elect the President by National Popular Vote. Once states totaling a majority of electoral votes have joined and the compact is in effect on July 20 of a presidential-election year, Virginia would appoint its presidential electors for the nationwide popular-vote winner rather than the ticket that carries Virginia. Member-state election officials would add popular votes from all 50 states and the District of Columbia, designate that winner, and certify their own state's elector slate accordingly. The compact's procedures would then supersede conflicting Virginia law. The compact ends if the Electoral College is abolished.

The Virginia Senate passed SB322 on February 9, 2026 by a vote of 21 to 19. We have assigned pluses to the nays because this interstate compact undermines Article II, Section 1 of the Constitution by sidestepping the Electoral College. The Electoral College is a constitutional feature of federalism that gives states a defined role in choosing the president, and prevents a handful of large population centers from dominating the outcome of elections.
